2. Data We Collect

• Contact information: name, phone number, email — provided voluntarily through our AI chat.
• Chat data: messages exchanged with AI assistant Ana, house preferences, qualification responses, optional file attachments.
• Technical data: IP address, browser type, device, pages visited — via cookies with your consent.
• Marketing data: UTM parameters, fbclid, gclid — to measure ad effectiveness.

3. Purposes & Legal Basis (GDPR Art. 6)

• Respond to inquiries and provide personalized home recommendations — Art. 6(1)(b) pre-contractual measures.
• Follow up via phone or email regarding your consultation — Art. 6(1)(b).
• Analytics and marketing — Art. 6(1)(a) consent (via cookie banner).
• Service improvement and security — Art. 6(1)(f) legitimate interest.
• Legal obligations (accounting, tax) — Art. 6(1)(c).

4. Automated Decision-Making & AI (Art. 22 + AI Act Art. 50)

You are interacting with Ana, an AI-powered assistant built on a large language model (OpenAI). Ana is not a human. This is disclosed on first load via a modal and through the persistent “🤖 AI” badge in the chat header, in compliance with Article 50 of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689).

Ana qualifies inquiries and suggests suitable home models, but final decisions — pricing, contracts, appointments — are always made by a human team member. You have the right under Article 22 GDPR to request human review, express your viewpoint, and contest automated decisions. Type “human” or “consultant” in the chat to be connected to a person.

We do not perform emotion recognition or psychological profiling of users, in compliance with Article 5(1)(f) of the EU AI Act.

5. Cookies

We use cookies only with your consent (via the cookie banner on first visit). Categories:

• Essential cookies: required for site functionality (consent storage, session, language).
• Analytics cookies (optional): Google Analytics — to understand site usage.
• Marketing cookies (optional): Meta Pixel, Google Ads — for campaign measurement.

6. Recipients & Processors

We may share data with the following categories of processors under Article 28 GDPR agreements:

• OpenAI Ireland Limited — AI large language model powering Ana.
• Telegram Messenger Inc. — internal lead notifications to our team.
• CRM software providers — candidate/lead management.
• Vercel Inc. — hosting and edge functions.
• Cloudflare, Inc. — CDN and DDoS protection.
• Google Ireland Limited — analytics and advertising (with consent).
• Meta Platforms Ireland Limited — advertising pixel (with consent).

7. International Data Transfers

Some recipients may process data in the United States. These transfers rely on the EU-U.S. Data Privacy Framework (DPF) adequacy decision and/or Standard Contractual Clauses under Commission Decision (EU) 2021/914. Request a copy of safeguards at privacy@foqushouse.com.

8. Data Retention

• Ana chat conversations: 6 months, then anonymization.
• Leads not converted: 3 months from last contact.
• Client records (home purchase contract): 10 years (Czech Accounting Act 563/1991).
• Marketing contacts: until consent withdrawal or 3 years of inactivity.
• Server logs and cookies: 1–24 months (see Cookie Policy).

9. Your Rights (GDPR Art. 15–21)

You have the right to:

• Access your personal data (Art. 15)
• Rectify inaccurate data (Art. 16)
• Erasure / right to be forgotten (Art. 17) — use the “Delete my chat history” button in the chat or email us
• Restrict processing (Art. 18)
• Data portability (Art. 20)
• Object to processing based on legitimate interest (Art. 21)
• Withdraw consent at any time (Art. 7(3))
• Not be subject to solely automated decisions (Art. 22)

10. Sensitive Data

We do not request or require sensitive personal data under Article 9 GDPR (health, religion, ethnicity, political views, trade union membership, sexual orientation). Please do not include such data in chat messages — per Czech Labour Code §316(4) this data is also not requested in recruitment contexts.

12. Security

We use TLS 1.3 in transit, encrypted storage, access controls, and regular backups. In case of a security incident with high risk to your rights, we will notify you within 72 hours per Article 34 GDPR.

13. Updates

This policy may be updated. Current version is always available at i.foqushouse.com/privacy. Material changes will be notified via the website 30 days before effective date.
